Terms and Conditions

 

At present all Winkers® are custom made and the quality of our services depends on your following the instructions below. Due to the great demand there is a waiting list (at present, 15 business day from receipt of your order)

Instructions
First select a pair of pants that creases between your thigh and buttocks as you walk and that are in good condition. Wash the pants before you send them to us and do not use softener or anything other than regular detergent (not one with softener). Any fabric softener product will interfere with the paint adherence. If the pants are new they must be washed at least once. Pre-washing will prevent shrinkage after the paint has been applied.

You must mark your pants as shown in the attachment. If you can put safety pins where these marks are it will insure the position of the marks, so that they are not accidentally rubbed off in handling. From these marks the size and position of the “winking” or animated part of the design is determined and painted. It is a good idea to have someone else mark the pants while you are wearing them. Dark pants take longer to do and the WINKERS ® price is adjusted accordingly.


Warranty and Limitation of Liability


WINKERS, LLC uses a special paint for fabrics that has been set by WINKERS, LLC as per the paint manufacturer’s specifications.  To keep your WINKERS bright please follow the paint manufacturer’s instructions for washing them:  turn  your pants inside out, machine wash them separately in cold water only, use gentle cycle, gentle detergent, and NO bleach, set your dryer temperature to mild.  The paint can sustain dry cleaning but verify that the fabric of your pants can be dry-cleaned.  The paint is not flame retardant and the painted item should not be used as sleepwear.

 We suggest that you insure your pants when you send them to us (for the replacement value of the pants). Until we receive them, the risk of loss is yours. When we mail the pants back to you they will be insured only for the amount that you indicate in the order form (the replacement value of the pants and the price of the Winkers™ design you selected). The insurance amount you select for return of the pants will also be the basis for our insurance while the pants are in our possession. WINKERS, LLC’S LIABILITY IS LIMITED TO THAT INSURED AMOUNT.

 

WINKERS, LLC, is the owner of a pending patent for the technique allowing correct placement of the design to produce the “Winking” effect.  We warrant that our design on your pants will “wink”.  WE DISCLAIM ALL OTHER WARRANTIES AS TO THE WINKERS DESIGNS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INTELLECTUAL PROPERTY VALIDITY, INTELLECTUAL PROPERTY NON INFRINGEMENT, OR OTHER STATUTORY WARRANTY EXCEPT AS EXPRESSLY SET FORTH HEREIN.

Dispute Resolution

ANY DISPUTE BETWEEN YOU AND WINKERS, LLC WILL BE BROUGHT IN A COURT OF LAW IN SEATTLE, WASHINGTON STATE. THE APPLICABLE LAW WILL BE THE LAW OF THE STATE OF WASHINGTON, EXCLUDING ITS CONFLICT OF LAWS RULES AND EXCLUDING THE ON THE SALE OF GOODS.

Please print all pages of the Order Form (found under each design below), fill them out, and send them with your pants. To receive these documents via email, please fill out the contact section of this website. These documents include instructions for how to mark your pants as well as our terms and conditions.
