WINKERS, LLC’s intellectual property (IP) available for licensing consists of: (1) a patent application for the invention of animating decorations placed on and around the fabric folds caused by a walking motion, (2) WINKERS trademarks for garments (goods) and for embellishments of garments (services); (3) copyrights for the various designs applied to the garments; (4) a very popular website.  WINKERS, LLC would consider licensing either all of these or as little as just the patent application and the trademarks (if the licensee provides his/her own designs and he/she does not want a link on WINKERS, LLC’s website, for example).

 

A typical license would feature a non refundable up front fee (depending on which IP is licensed, for how long, for which geographical area, how many designs, etc.) and thereafter a running royalty ($X per unit or X% of the selling price) with minimum yearly royalties if the license has some elements of exclusivity (for some territories, for some designs, for some types of pants, etc.).  A comprehensive exclusive license may not be in WINKERS LLC’s best interest if the licensee’s sales projections are small, but a non exclusive license could still be negotiated.  An assignment (sale) of the IP may be considered upon the right offer.
